According to the lawsuit, Ex Populus has operated under the XAI trademark in U.S. commerce since that time, using the name to brand its blockchain-based gaming platform and its corresponding cryptocurrency, the $XAI token.

According to the complaint, this confusion has led to “irreparable harm” to Xai’s brand identity and long-standing goodwill.
